Unauthorized Use Of My Photo

Actually a little flattering and I won't be making any noise about it but I was wondering what you think about it and what you might actually know for a fact about it. Someone has linked to thumbnails of my photos and another SP contributors in an add to sell a lens. They are showing examples of photos made with the lens. Is this copyright infringement? Again, this instance doesn't really bother me, it's kind of a compliment.
I followed the link from a comp download in my balance and sales.
What do you think?
